1. Acceptance of Terms

By accessing or using Mapfolio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Mapfolio is a spatial data platform that allows users to create custom maps with layers, polygons, markers, and file attachments. The Service includes team collaboration features and organization management tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must provide accurate and complete information during registration and keep your account information up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscription and Payment

Access to the Service requires an active subscription at €200 per month. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

You may cancel your subscription at any time through the Stripe billing portal. Upon cancellation, you will retain access to the Service until the end of your current billing cycle. No refunds are provided for partial billing periods.

If a payment fails, you will have a 3-day grace period to update your payment method. After the grace period, your access to the Service will be suspended until payment is resolved.

5. Acceptable Use

You agree not to use the Service to: upload or distribute malicious software; violate any applicable laws or regulations; infringe on the intellectual property rights of others; harass, abuse, or harm other users; attempt to gain unauthorized access to the Service or its related systems; or use the Service for any illegal or unauthorized purpose.

We reserve the right to investigate and take appropriate action against anyone who violates this provision, including removing content and suspending or terminating accounts.

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Mapfolio and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all data and content you upload to the Service.

By uploading content to the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. We will not use your content for any other purpose without your explicit consent.

7. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

8. Termination

We may terminate or suspend your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by canceling your subscription and contacting us to request account deletion.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Mapfolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

In no event shall our aggregate liability exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable member state in which Mapfolio operates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
